Virginia's Fault and No-Fault Divorce Laws

Divorce may be granted on either a no-fault or a fault basis in Virginia. The grounds for a fault-based divorce are adultery, cruelty and desertion, and the felony conviction of a spouse (if incarcerated for more than one year).

If you are seeking a divorce based on fault grounds, you can file once the conditions giving rise to that specific ground exist. If you are seeking a divorce based on no-fault grounds, the law requires you and your spouse to live separately and apart for a specified period of time. If you and your spouse have minor children, that period is one year. If you do not have minor children the period remains one year unless you have entered into a written agreement, in which case the period is six months.
